Procedure of Application for Non-Criminal Record in Hong Kong
Notes for applicants who are in Hong Kong
- Applicable to applicants (regardless of nationality) who are in Hong Kong or will visit Hong Kong, applicants must apply in person at this office
The issuance of a "Certificate of No Criminal Record" (commonly known as a "good citizen certificate") is a fee-based service provided by the Hong Kong Police Force. The "Certificate of No Criminal Record" issued by the Department is purely for the relevant person to apply for various types of entry visas (including travel, education or residence, etc.), or to apply for adoption of children. Applications for the issuance of a "Certificate of No Criminal Record" for any other purpose will not be accepted. (Except Government Official Prove)
Application procedures and required documents
2. Applicants must go to the "Certificate of No Criminal Record Office" on the 14th floor of the Arsenal Building, Police Headquarters, No. 1 Arsenal Street, Wan Chai, Hong Kong. The office hours of the office for accepting applications and payment are as follows:
Monday to Friday, 9 am to 5:15 pm*
Closed on Saturdays, Sundays/ Public Holidays
* The cashier department of the police headquarters will stop accepting cash/ cheque payments from 1:00 pm to 2:00 pm and after 5:00 pm
3. Applicants must bring the following application documents to apply. All documents (except items c and f) must be submitted. It is recommended that applicants refer to the FAQ before submitting the application.
a. The original of the completed application form (Application form 172a.pdf);
b. The original signed and agreed to accept the fingerprint taken form; (Fingerprint Consent form 172b.pdf);
c. Applicant's information form (only applicable to applications related to visa or permanent residency); (Applicant Personal Data form dcs331.pdf)
d. Applicant's Hong Kong Identity Card (if Hong Kong resident) / original valid travel document (Passport);
e. The Original and Photocopy of the letter issued by the relevant consulate/immigration bureau/ government department (one photocopy for each applicant). The letter must contain the name of the applicant and clearly state that the consulate/immigration/government department requires the applicant’s certificate of no criminal record for approval purposes; and the Postal Address of the consulate/ immigration/ government department. The application results will be sent directly to the office by registered mail from the Hong Kong Police Force. (For details, please refer to paragraphs 9 to 12 below.) If the letter is an electronic version, the applicant must submit a hard copy;
f. The Original and Photocopy of documents proving the relationship between the applicant and the main visa applicant, such as marriage certificate, birth certificate, etc.; (Only applicable when the applicant's name is not included in the letter from the consulate/immigration bureau/government department in item e above)
g. The application fee is HK$283 per person. Payment can be made by cash, Octopus card, EPS or cheque. If paying by cheque, please cross the cheque and state "The Government of the Hong Kong Special Administrative Region" as the payee. They do not provide value-added services for Octopus cards.
4. If applicants use the electronic version of the application documents, they must arrange their printed copies for submission. This office does not provide printing services. Regarding the application forms that can be downloaded from items a to c in the third paragraph above, the applicant's information fill-in form, and the acceptance of fingerprint taken, this office only accepts the printed version with the applicant's handwritten signature. The entire application process does not accept electronic submission of documents.
5. If the application documents are not written in Chinese or English, the applicant must also submit a Chinese or English translation; the translation must be verified by the issuing authority or a translation agency recognized by the government.
Online and telephone appointment
6. Applicants are recommended to go through the online appointment system (https://www.obs.police.gov.hk/en) or call the automatic telephone enquiry system at 2396 5351 at least one day before the appointment time. Walk-in application will not be entertained.
7. The appointment system can provide dates within the next 60 days from the next day for selection. If all the time slots available for appointment are full, you can try again later. If other applicants cancel the appointment during the period, the open time slot will also be available for re-appointment.
Consent for Fingerprint Taking and Authorization to Disclose Criminal Records
8. By signing the Fingerprint consent form mentioned in paragraph 3(b) above, applicants consent to have their fingerprints taken and retained by the Hong Kong Police Force as well as that details of any criminal conviction recorded against him or her can be disclosed to the appropriate Consulate / Immigration Authority / Government Authority without prior reference to him or her.
Time required to process the application and issue the certificate
9. If the Hong Kong Police Force does not have a criminal record of the applicant, the "Certificate of No Criminal Record" will be sent directly to the relevant consulate/immigration bureau/Government Department by registered letter within four weeks after the required application documents and fees are collected. The applicant will NOT receive the original or copy of the relevant certificate.

10. If the applicant has a criminal record, the Department will notify the relevant consulate/immigration bureau/government department and the applicant by a registered letter, stating that the applicant cannot issue a "Certificate of No Criminal Record" and list the criminal record information .
11. If the applicant is under investigation by the Hong Kong Police Force/Hong Kong law enforcement agency, or is a defendant in Hong Kong criminal proceedings, or a person who owes fines (including traffic contraventions), his application will not be processed further until the conclusion of the case/incident. The office will send a letter to inform applicants that their application will not be processed until the relevant case is over. When there are no other outstanding cases, the Hong Kong Police Force will issue a certificate or letter in accordance with the above paragraphs 9 and 10.
12. Applicants may access to the Hong Kong Post Office website to check the delivery time, but please note that the relevant time will be affected by the destination postal service.
Handling of personal data
13. The personal data provided by the applicant will only be used to process the application. They have the right to request in writing to the Chief Inspector (Support) of the Forensics Section, 10th Floor, West Wing, Arsenal Building, Police Headquarters, No. 1 Arsenal Street, Wan Chai, Hong Kong to access and correct their personal data. In order to recover the administrative fee for handling the relevant request, the applicant may have to pay for the photocopying of the required documents. In most cases, the relevant fees are the same as the photocopying fees currently charged by the government. After the application process is completed, the fingerprints and other personal data collected will be destroyed within a reasonable period of time.

C. Fingerprints

| Q.18 | How can I obtain a set of fingerprints overseas for CNCC application? | |
| A.18 | Usually overseas police station / law enforcement agency / Consulate would help with the fingerprint taking. If your full set of fingerprints is taken by other agencies appointed by the abovementioned authorities, a proof of the appointment is also needed for verification purpose. | |
| Q.19 | Shall I take the fingerprints with ink or electronically? | |
| A.19 | Fingerprints taken with ink or via live scan (i.e. electronically) are both acceptable. If your fingerprints are taken via a live scan device, a hard copy must be generated so the fingerprint card can be mailed to our office. | A.23 | Yes. During office hours, our office provides fingerprinting services to the public for free. Members of the public must book an appointment through the Online Booking System (https://online.booking.police.gov.hk). Those without an appointment will not be processed. Up to two sets of fingerprinting services will be provided for each appointment. To ensure proper use of this service, applicants must bring along any document issued from the overseas authority which bears your full name and reasons for fingerprints submission; or your passport showing the period of your stay in that relevant country; or a standard fingerprint form from the relevant Authority. | |
D. Payment

E. Processing time and issuance of result
| Q.27 | How long does it take for the application result to be issued? |

| A.27 | Being the most efficient and convenient avenue, online submission of application is highly recommended. Especially for applications meeting the listed conditions, processing time will be reduced to 15 calendar days. Applications submitted in person at CNCC Office or cases warranting additional processing steps under special circumstances shall take a longer time and the Office is committed to complete them in 28 calendar days. |
| Q.28 | Can I have my application prioritised? I have a deadline set by the relevant Consulate / Immigration Authority / Government Authority. |
| A.28 | No. There is no express service for the application. Please allow sufficient time for your CNCC application to be processed and apply early. |
| Q.29 | Will the result be sent to me or can I have a copy of the result? What if the requesting authority asks me to upload the CNCC online or bring the CNCC with me at the interview? |
| A.29 | No. The CNCC will be sent to the relevant Consulate / Immigration Authority / Government Authority only. Applicants will receive a copy only when they have criminal conviction record. The policy was established to prevent possible abuse of the certificate. |
| Q.30 | Can you attach a document from me when sending out the result so that the requesting authority can easily identify my application? |
| A.30 | No. The result will not be sent out with other documents provided by applicants. Nevertheless, if the applicant has provided the reference number assigned by the requesting authority, the reference number will be quoted on the result for identification. |
| Q.31 | How do I know if the result is issued? Will I be notified? |
| A.31 | Online applicants will be notified when their application is completed. Applicants who submitted application at the CNCC office counter will not be notified of the release of results. | Q.32 | What shall I do if the application result has been sent out but the requesting authority said they have not received the result? |
| A.32 | If the relevant authority does not receive the result and requires a true copy, a letter/official email (showing the sender and recipient's email addresses and sending date) from the relevant authority proving that the result was not received is required. Upon receipt of the letter/official mail, the certified copy of the result to be mailed to destinations in Hong Kong will be sent out by registered post as soon as possible. If the certified copy of the result is to be sent outside Hong Kong, applicants have to arrange courier service at their own expenses and respective shipment instructions will be provided when the result is ready. |
| Q.33 | Can the application result show my other names or aliases I am or have been known by, which is requested by the requesting authority? |
| A.33 | No. Only one name of the applicant as stated on either the HKID card or valid passport will be shown on the result of CNCC application, depending on the name shown on the request letter from the requesting authority. For other names of the applicants, including different names shown on the Birth Certificate / any Alias / Nick name / change of name, applicants will need to explain to the requesting authority on their own separately. |
| Q.34 | How long is the CNCC valid for? |
| A.34 | There is no expiry date / validity period for our results. There will only be an issue date. The expiry date/validity period is set by the relevant immigration authorities / Consulate / Government Authority. Therefore, please refer to the relevant Consulate / Immigration Authority / Government Authority for this requirement. |
| Q.35 | According to the immigration authorities / Consulate / Government Authority, the result has been expired. How can I renew the result? |
| A.35 | There is no renewal service for CNCC applications. Please submit a new application to our office with all required documents again, including a new request letter from the authority and fingerprints. The processing time is the same as a new CNCC application, which is four calendar weeks. |
| Q.36 | Can I apply for CNCC which only show the checking result within a certain time frame, for example, the recent five years? |
| A.36 | No. The checking will not be confined to a specific period while any criminal conviction record found to be kept by the Hong Kong Police Force will be revealed for the consideration of the relevant Consulate / Immigration Authority / Government Authority. Only the date of issue will be specified on the result. |
F. Criminal conviction records
| Q.37 | Can I still apply for the CNCC if I have criminal conviction record? |
|---|---|
| A.37 | Yes. Applicants with criminal conviction record can apply for the CNCC but the application result will be different. Please note that the "Certificate" will only be issued to the relevant Consulate / Immigration Authority / Government Authority if no criminal conviction data against the applicant is kept by the Hong Kong Police Force. If criminal conviction data is found, both the relevant Consulate / Immigration Authority / Government Authority and the applicant will be replied with a letter advising that the CNCC could not be issued and listing out the conviction data. |
| Q.38 | Can I apply for the CNCC if I have an outstanding case? |
| A.38 | Yes. Nevertheless, if an applicant is under investigation by the Hong Kong Police Force / law enforcement agencies in Hong Kong, or is currently a defendant in criminal proceedings in Hong Kong, or is subject of non-payment of fine including traffic offences, his/her application will not be further processed until the matter concerned has been concluded. We shall issue a letter to the applicant informing that his/her application is pending for the conclusion of the matter. Once there are no outstanding matters, the application result will be issued. |
| Q.39 | I have received a letter from your office regarding my application which states that your office is "unable to furnish a certificate". Does it mean that my application is rejected? |
| A.39 | No. For applicants with criminal conviction data found, a letter instead of CNCC will be sent to the relvant Consulate / Immigration Authority / Government Authority as well as the applicant to indicate the applicant’s conviction data, including the dates, offences and results of convictions as well as the fact that no CNCC could be furnished. |
| Q.40 | If the applicant is not sure whether he has any criminal conviction record, is there any other means to check? |
| A.40 | Yes. Please refer to the following service: In accordance with the Personal Data (Privacy) Ordinance, Criminal Conviction Data Office has been established to enable the public to enquire whether there is any criminal conviction record against him / her being kept by the Hong Kong Police Force. If conviction data is found, a copy of the records will be given to the requester. If no conviction data is located, the requester will be only advised of the result verbally. | Q.41 | I received a letter of my criminal conviction records which states that "the conviction is regarded as spent in Hong Kong". Does it mean that the conviction is deleted? Can I apply to have my conviction record deleted? |
| A.41 | If the applicant's conviction record was considered as spent according to Section 2(1) of Rehabilitation of Offenders Ordinance (Cap. 297 of Laws of Hong Kong) (ROO):- According to ROO, where an individual has been convicted in Hong Kong of an offence in respect of which he was not sentenced to imprisonment exceeding 3 months or to a fine exceeding $10,000; he has not been convicted in Hong Kong on any earlier day of an offence; and a period of 3 years has elapsed without that individual being again convicted in Hong Kong of an offence, the individual shall, three years after his conviction, be deemed to have no conviction record save for the exceptions specified in sections 3 and 4 of ROO. For applications of Certificate of No Criminal Conviction, the "spent" conviction record will be listed in the reply letter with a note that the relevant conviction is regarded as spent in Hong Kong by virtue of Section 2(1) of the ROO. There is no mechanism to remove the existing criminal conviction record if a person was found convicted. Note: This FAQ is not a legal document.
